SmartGroove is a creative tool. This Acceptable Use Policy ("AUP") describes conduct that is prohibited when using SmartGroove's web services or desktop Software, with particular attention to AI-generated content. The AUP supplements our Terms of Service and EULA; defined terms used here have the same meaning as in those documents.
1. Spirit of the Policy
SmartGroove gives you powerful tools, including AI features capable of generating and transforming audio. We are intentionally permissive about legitimate creative use, including parody, sampling, remixing, and stylistic experimentation. The prohibitions below target categories of use that are illegal, harmful to identifiable third parties, or designed to abuse the Service. If you're unsure whether a specific use is permitted, write to us at [email protected] — we'd rather answer questions than terminate accounts.
2. Prohibited Uses (General)
You may not use SmartGroove to:
- Violate any applicable law or regulation.
- Infringe the intellectual-property rights of others.
- Distribute malware, viruses, or other harmful code.
- Send spam, phishing communications, or other unsolicited messages.
- Harass, defame, threaten, or stalk identifiable individuals.
- Impersonate any person or entity in a way intended to deceive.
- Probe, scan, or test the vulnerability of SmartGroove's systems or the Software's update channel.
- Reverse-engineer, tamper with, or otherwise bypass the AI Credit metering or any rate-limiting mechanism (see also EULA §5(d)).
- Attempt to extract model weights, training data, or upstream provider system prompts via prompt injection or similar techniques.
3. AI-Generated Content (Specific)
3.1 Voice cloning
You may not use SmartGroove's AI features to generate audio that imitates the voice or vocal style of any identifiable real person without that person's explicit, documented, written consent. This applies to public figures, private individuals, deceased persons (where local right-of-publicity laws extend post-mortem), and to the use of your own voice when impersonating someone else's identity. Synthesizing a generic voice for your own creative use, including voices that do not target a specific identifiable person, is permitted.
3.2 Copyright and trademark
You may not use SmartGroove to:
- Generate output intended to be passed off as the work of a specific copyrighted artist, label, or producer.
- Generate output that reproduces substantial recognizable elements of a specific copyrighted recording or composition.
- Generate output for use in trademark-infringing contexts.
General stylistic inspiration — describing a genre, era, instrument palette, or production technique — is permitted. Imitation of a specific named artist's identifiable work, in a way intended to substitute for or be confused with that artist's output, is not.
3.3 Malicious and harmful content
You may not use SmartGroove to generate:
- Content that sexualizes minors (CSAM), in any form.
- Content depicting non-consensual sexual acts.
- Content advocating violence, terrorism, or self-harm.
- Defamatory content targeting identifiable individuals.
- Deepfake content intended to deceive viewers about real events or statements by real people.
- Content designed to defraud, scam, or manipulate listeners (including but not limited to fake-endorsement audio or fake-press-release audio).
3.4 Credit-system abuse
Circumventing or attempting to circumvent the AI Credit metering — including via reverse-engineering the proxy protocol, sharing accounts to pool Credits, automating chat input to extract bulk Credits, or any technical or social workaround intended to obtain AI features without paying for them — is grounds for immediate account termination without refund. EULA §5(d) governs.
3.5 Upstream content policies
The AI providers SmartGroove uses (currently Anthropic) enforce additional content policies on prompts and outputs. Prompts that violate the upstream provider's policies will be rejected at the proxy and the Credit charge will be reversed. SmartGroove logs prompts sent to the AI assistant per EULA §4(b); we may review logged prompts when investigating suspected AUP violations or upstream-policy rejections, in line with the limits in EULA §4(c)–(e).
4. Plugin and Third-Party Content
SmartGroove hosts third-party VST3 and CLAP plugins in a sandboxed process. You are responsible for complying with the license of any plugin you install. SmartGroove does not review, license, or warrant third-party plugin behavior.
5. Reporting Abuse
To report suspected abuse, illegal content, or violations of this AUP, write to [email protected] with the subject line "ABUSE REPORT" and as much detail as you can share (URLs, account names, screenshots, dates). At Beta scale we aim to respond within five (5) business days.
6. Consequences
For a first violation we will typically issue a written warning and require removal of offending content where applicable. For repeat or severe violations — including any violation of §3.3 (Malicious and harmful content) or §3.4 (Credit-system abuse) — we may suspend or permanently terminate your account immediately. On termination for AUP violation: unused Credits are forfeited; paid subscription remainders are handled per the Refund Policy; SmartGroove may report illegal content to law enforcement where required by law.
7. Changes to This Policy
We may update this AUP at any time, in our sole discretion, without prior notice, to address emerging abuse patterns or to clarify existing rules. The current version is the one published at smartgroove.app/legal/acceptable-use, and the "Effective" date at the top of this document indicates when it last changed.
